Dear USA -ALL Action Alert Subscribers,

Even if you commented on this bill already please read this email as we are asking for some additional help

Earlier today we notified you regarding Senate Bill 181 Which would allow certain ATVʼs to attain street legal status and travel on certain public streets. The bill was circled late in the day which means the bill sponsor requested that itʼs place on the calendar be held but that he would postpone the floor debate until he had a few things worked out. At the last minute we had a group that was neutral on the bill last year and hadnʼt taken a position on the bill this year decide it was against it. So you still have time to comment on this bill. As we explained earlier USA-ALL supports the purpose of this legislation, and we would like to see this bill progress through the senate and on into the house. PLEASE TAKE THE TIME TO SUBMIT YOUR BREIF COMMENTS ON THIS BILL. WE REALLY NEED YOUR SUPPORT.

*************Below is an additional action item that we really need help with**********

The organization that is opposed to the bill is the Utah League of Cities and Towns. They represent almost every city and town in the state. At 2:00 PM today their legislative affairs person held a meeting with some of their member cities and received strong opposition to the bill from urban cities which is to be expected and shockingly a few rural areas most notably from the city of Vernal . We are asking ALL OF you call your mayor, local city counsel persons AND county commissioners and indicate your support of this bill and that you would appreciate it if they would pass that on up to your respective legislators and to the Utah league of Cities and towns We need to really flood the right people with calls all day on Wednesday so that we can move the bill forward on Thursday.

The main concern some cities and counties are having is no surprise. They want to have the ability to determine which streets will be open to Street Legal ATVs.  Our position is simply this: the State of Utah holds the right to determine if a vehicle has street legal status or not, and it is best regulated at the state level. We ARE NOT trying to give regular ATVʼs a rubber stamp approval to drive on public streets. Under this bill there are safety and equipment requirements, a licensing and registration procedure that a ATV and itʼs owner will undergo, to attain Street Legal status. Municipalities CANNOT restrict the publicʼs right to legally drive a street legal dual sport motorcycle on public roads; they also should not have the ability to restrict legitimate street legal ATV use. Under the bill there are a few exceptions such as the interstates and freeway systems would be off limits, there have been other precautions and precluded roads including roads in the most urban areas and larger cities. But we donʼt want to give a blanket provision in the bill to allow most or all government entities the ability to dictate street legal ATV access. They would however retain their right to regulate the use of REGULAR ATVs on their streets so they can still allow for designated routes open to regular ATVs. Either this bill establishes a STREET LEGAL status under state law or it does not and currently cities and counties do not determine that for ANY street legal vehicle nor do we want to allow that with street legal ATVs. Simply put we want to create a new classification for ATVʼs that gives operators of these specialized vehicles the same rights as other street legal motorized vehicles.

We wish we could include an easy contact number for each of your towns. This is one were you will have to open your phone book and either call your mayor, council people or commissioners directly, or at the city or county offices. Your effort and help is greatly appreciated and we PROMISE it is worth your time and your effort WILL MAKE A DIFFERENCE. Senator Darin Peterson replied back to me that the bill has passed the Senate and has moved on to the house.

I have reservations about how the bill is written. It leaves in way too many loop holes for counties and cities to still ban the use of "street-legal all-terrain vehicle" on the streets or highways. I think it needs some clearer language.  

One line says "A person may not operate an off-highway vehicle upon any street or highway, not designated as open to off-highway vehicle use". Does this mean every street, road and highway must now go through a travel management review and be designated as open or closed to off-highway vehicle use? Or did I misunderstand that section. (41-22-10.3. Operation of vehicles on highways -- Limits)

Clicking the links provided, I see I'm going to make a few calls.

Sheldon Killpack is my sister's neighbor.  I've know him a couple of years.

Paul Ray lived 4 doors down from me in Clinton and my wife sees his wife every day at our daughter's school.

And Greg Bell lived just up the street from my parents and is a good friend of the family.

I'm going to give them a holler and let them know where I (we) stand.

That's exactly one of the questions of several I asked in my email.  I agree that some of the bill's language is too general and leaves many to interpret it  as they wish.  I really hope I get the response I requested.

yes it has a population limit of 5,000 on towns.  Cities and counties of "the first class" (what ever that means) are excluded unless they pass their own laws to allow OHV use.

Population (year 2000): 12,081. Estimated population in July 2006: 15,540 (+28.6% change).

I remember way back when .......


Farmington had just over 1000 residents.  That was when I was just a young feller though.  We only had one church house in town too.  I remember my uncle was helping to build that old red church and fell off a wall and hurt his back pretty badly.

The place has certainly grown a lot since then.

Unrealated....but is that the rock church? My great great grandfather Job Welling is on the mural in there.

The Rock Church was the first.  Then the chruch built a new chapel in North Farmington.  It's no longer in use as a church while the Rock Church is.

Which part of SB 181 are you referring to?

In the letter form USA-ALL they are referring to ATVs which meet the equipment and other requirements such as insurance etc...

Scroll to "41-6a-102.  Definitions." and down to the new definition (61):

(61) "Street-legal all-terrain vehicle" or "street-legal ATV" means an all-terrain type I or type II vehicle, as defined in Section 41-22-2 , that is modified to meet the requirements of Section 41-6a-1509 to operate on highways in the state in accordance with Section 41-6a-1509.

Cutting to the chase...

If doznfire had asked: "would this cover UTVs?" The answer would be: yes, it does, because UTVs fit the Type II ATV definition.

I don't know how they expect anyone to follow these bills with all the amendments, substitutes, amended substitutes, substituted amendments, additions, retractions, and so on with  the system in place on the states website. Why can they follow something similar to a Forum thread where the most recent is at the end of the thread?  Huh
I thought I was reading and linking to to the substitute bill as it had been amended  Huh

This though just confirms my complaint about the bill having too much confusing language. When it simply said off highway vehicles it seemed a lot clearer to me. Now they added the terms ATV, Class 1, Class II and it seems to me to confuse the issue. I can understand the use of Class 1 and Class II, but why confuse people by adding "ATV" to the wording? Resulting in the UTV people now asking does this exclude me?

I'm sorry, but I just don't see where this bill helps anyone with an ATV or UTV.  In order to become street legal as I understand state law you would have to do away with low pressure tires.  Wouldn't that kind of put a damper on riding trails not to mention alter the way the vehicles handle?  To me this just looks like a self serving bill by those (at USA-ALL) who see the opportunity to sell some insurance to those who want their off road jeeps, motorcycles, atv and utvs street legal. I could be wrong but as for me...thanks, but no thanks.

Cat Lover I do not see the street tire requirements in this years bill. Smiley This years talks about lights and horns and a "safety inspection" (which doesn't seem to be defined) so I think it's a step in the right direction. It's still to complicated for the average person to understand and has way too much complicated language so it can be misread and miss interpreted. I'm an example of that already  Rolling on floor laughing

I just think it needs some more work to refine it and simplify the language.

I was confused in all the reading between the lines of the law and bill talk. It just seemed like it should be worded "atv's that meet certain requirements" not "certain atv's"...... I guess there are pros and cons? Back to reading, man my eyes hurt  Wink
